Terms of Use

These Terms of Use ("Terms") govern your use of the Contrail mobile application ("the App") developed by Jacob Lassen ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Contrail, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the App.

2. Description of Service

Contrail is a flight tracking application that displays real-time aircraft positions on an interactive map. The App allows you to:

  • View live aircraft positions sourced from ADS-B community data
  • Access flight details including route, altitude, speed, and gate information
  • Monitor specific flights for status updates
  • Search for flights by airline code or flight number

3. Data Accuracy and Limitations

Contrail is provided for informational and entertainment purposes only.

  • Aircraft position data is sourced from community-operated ADS-B receiver networks (adsb.lol) and is not guaranteed to be complete, accurate, or up-to-date.
  • Flight details are enriched from third-party data providers and may contain errors or outdated information.
  • Not all aircraft broadcast ADS-B signals; coverage varies by region and altitude.
  • Data may be delayed, incomplete, or temporarily unavailable.

Contrail must not be used for navigation, aviation safety, flight planning, or any safety-critical purpose. Always rely on official aviation authorities, airline communications, and certified aviation systems for operational decisions.

4. In-App Purchases

Contrail offers optional in-app purchases in the form of a tip jar to support ongoing development. These purchases are:

  • Entirely voluntary and do not unlock additional features
  • Processed through Apple's App Store and RevenueCat
  • Non-refundable, except as required by applicable law or Apple's refund policies
  • Subject to Apple's standard App Store terms and pricing

5. User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not attempt to reverse-engineer, decompile, or disassemble the App
  • Not attempt to access our backend API outside of normal App usage
  • Not use automated systems (bots, scrapers) to access the service
  • Not redistribute or resell data obtained through the App
  • Not use the App in any way that could impair its operation for other users

6. Intellectual Property

The App, including its design, code, graphics, and the Contrail name and logo, are the intellectual property of Jacob Lassen. Aircraft data is sourced from third parties and is subject to their respective terms. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Availability and Modifications

We reserve the right to:

  • Modify, suspend, or discontinue the App or any part of it at any time
  • Update these Terms at any time, with changes effective upon posting
  • Limit access to certain features or the entire service

We will make reasonable efforts to provide notice of significant changes, but continued use of the App constitutes acceptance of updated Terms.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • Flight data will be accurate, complete, or timely
  • The App will meet your specific requirements
  • Defects will be corrected in a timely manner

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JACOB LASSEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Jacob Lassen from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App or violation of these Terms.

11. Third-Party Services

The App relies on third-party services including adsb.lol, AeroDataBox, RevenueCat, and Cloudflare. Your use of the App is also subject to Apple's standard End User License Agreement (EULA) for licensed applications. We are not responsible for the availability, accuracy, or policies of third-party services.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Norway.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
